Sin embargo,\u00a0<strong>a Mondel?z le sent\u00f3 a cuerno quemado la campa\u00f1a de marras y interpuso una demanda contra Tony\u2019s Chocolonely por remedar el caracter\u00edstico color lila de las tabletas de chocolate de su subsidiaria Milka.<\/strong><\/p>\n<p>Esa denuncia forz\u00f3 a la postre a Tony\u2019s Chocolonely a poner en pausa su campa\u00f1a, pero\u00a0<strong>la marca de chocolate convirti\u00f3 lo que\u00a0parec\u00eda<\/strong>\u00a0<strong>a bote pronto un important\u00edsimo rev\u00e9s en un golpe maestro contra\u00a0Mondel?z.<\/strong><\/p>\n<p>En un post publicado en LinkedIn la marca neerlandesa publicaba la semana pasada una llamativa imagen en el que su particular clon de las tabletas de chocolate de Milka aparece con un envase de color gris (haciendo adem\u00e1s espec\u00edficamente referencia a que el color del packaging no es de color lila, cumpliendo por ende el mandato judicial de Mondel?z)<strong>. Sin embargo, lo m\u00e1s duro no es la imagen en s\u00ed misma sino la frase que la preside: \u00abPay farmers, not lawyers\u00bb (Pagad a los agricultores, no a los abogados).<\/strong><\/p>\n<p><iframe loading=\"lazy\" title=\"Publicaci\u00f3n integrada\" src=\"https:\/\/www.linkedin.com\/embed\/feed\/update\/urn:li:share:7166367009885143040\" width=\"504\" height=\"1015\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p><strong>Tony Chocolonely\u2019s explica en esa publicaci\u00f3n en LinkedIn que un competidor al que no pone en ning\u00fan momento nombre ha recurrido a los tribunales para obligarle a retirar las im\u00e1genes y los envases\u00a0<\/strong>en los que imita el caracter\u00edstico color lila de\u00a0Milka, que es marca registrada y no puede ser empleado, por consiguiente, por rivales que se desenvuelven en el mismo \u00e1mbito de actividad.<\/p>\n<p>\u00abHemos tenido que cambiar nuestras tabletas de chocolate, pero eso no quiere decir que vayamos a dejar de dar cuenta de los mayores\u00a0<strong>problemas en la industria del cacao<\/strong>, que incluyen la ausencia de emolumentos justos para que los productores de cacao puedan subsistir, la explotaci\u00f3n infantil y la deforestaci\u00f3n\u00bb, dice la marca neerlandesa de chocolate.<\/p>\n<p>Un portavoz de Mondel?z ha confirmado en declaraciones a\u00a0<em>Adweek<\/em>\u00a0que la compa\u00f1\u00eda demand\u00f3 efectivamente a Tony\u2019s Chocolonely por su \u00faltima campa\u00f1a en Alemania y Austria.\u00a0<strong>No es todo caso la primera vez que la multinacional estadounidense recurre a los tribunales para proteger el uso del caracter\u00edstico color lila del packaging de Milka.<\/strong>\u00a0Mondel?z se enzarz\u00f3 con Nestl\u00e9 en una larga batalla legal en Reino Unido cuando la marca Quality Street, subsidiaria de la empresa helv\u00e9tica, lanz\u00f3 una nueva variante de chocolate provista de un packaging de color p\u00farpura.<\/p>\n<p><strong>Mondel?z perdi\u00f3 en los tribunales, pero asegur\u00f3 que continuar\u00eda protegiendo los elementos caracter\u00edsticos de la marca Milka.<\/strong>\u00a0Y dos a\u00f1os despu\u00e9s de aquel caso la compa\u00f1\u00eda envi\u00f3 asimismo una carta de desistimiento a Nurture Brands, que hab\u00eda comenzado a distribuir una nueva tableta de chocolate bautizada con el nombre de The Primal Pantry y pertrechada de un envase de color lila similar al de Milka.<\/p>\n<p>Fuente:
