hide_on_mobile=\u00bbsmall-visibility,medium-visibility,large-visibility\u00bb sticky_display=\u00bbnormal,sticky\u00bb]\n<p><b>Hechos del caso:<\/b><\/p>\n<p>Ana Mar\u00eda Am\u00e9zquita se vincul\u00f3 como trabajadora oficial a la Oficina de Registro de Instrumentos P\u00fablicos de Ibagu\u00e9 en 1998. A partir de los 2 a\u00f1os de trabajar en dicha oficina fue convocada a tramitar un proceso disciplinario que inici\u00f3 el Consejo Superior de la Judicatura en contra del c\u00f3nyuge de quien era la registradora principal de la oficina, Lola del R\u00edo Van Leeden. La se\u00f1ora Ana Mar\u00eda cumpli\u00f3 a cabalidad las \u00f3rdenes impuestas por el Consejo Superior. Como consecuencia del proceso disciplinario, Del R\u00edo fue suspendida por m\u00e1s de un a\u00f1o de su cargo, retornando a sus labores cumplido el plazo. Desde su regreso, Del R\u00edo comenz\u00f3 a asignarle m\u00e1s funciones y tareas a Am\u00e9zquita, la obligaba a participar en labores de coordinaci\u00f3n, tramitaci\u00f3n, contabilizaci\u00f3n, aseo y otras funciones diferentes a las se\u00f1aladas en su contrato por nombramiento, con la excusa de que el personal calificado en la oficina era escaso. Le orden\u00f3 incluso a realizar la limpieza de las instalaciones de otras oficinas de registro.<\/p>\n<p>En 2002 Del R\u00edo le impuso memorando a Am\u00e9zquita alegando que no cumpl\u00eda las tareas asignadas. En el documento us\u00f3 un lenguaje despectivo para referirse a su subordinada y la descalific\u00f3 en frente de sus compa\u00f1eros de trabajo. En 2004, por reparaci\u00f3n de la planta f\u00edsica, Del R\u00edo desplaz\u00f3 a Am\u00e9zquita a un lugar oscuro y peque\u00f1o cerca del archivo, donde sufri\u00f3 un accidente laboral: una caja le cay\u00f3 en la espalda. Sin embargo, el accidente no le dej\u00f3 secuelas f\u00edsicas. Esta situaci\u00f3n le gener\u00f3 episodios agudos de estr\u00e9s a la se\u00f1ora Ana Mar\u00eda, motivo por el cual le hicieron dict\u00e1menes m\u00e9dicos que la diagnosticaron con graves afectaciones psicol\u00f3gicas y psiqui\u00e1tricas asociadas a estr\u00e9s laboral. Basada en este diagn\u00f3stico, solicit\u00f3 el traslado a una dependencia diferente, debido al acoso que sufr\u00eda por parte de Del R\u00edo, quien era su jefa y la registradora principal. La Superintendencia de Notariado y Registro neg\u00f3 la solicitud alegando que no exist\u00eda acoso, toda vez que la oficina presentaba problemas asociados a la falta de personal.<\/p>\n<\/p>\n<\/p>\n<p>Ante la negativa, Am\u00e9zquita present\u00f3 acci\u00f3n de tutela para que se hiciera efectivo su traslado. La tutela fue concedida y a principios de 2006 la reubicaron en la Oficina de Registro en Armenia. hide_on_mobile=\u00bbsmall-visibility,medium-visibility,large-visibility\u00bb sticky_display=\u00bbnormal,sticky\u00bb]\n<p><b>Argumentos y decisi\u00f3n:<\/b><\/p>\n<p>El acoso laboral es una situaci\u00f3n repetida en el tiempo que no se agota, en muchas ocasiones, con un solo evento. Tiene como objetivo minar, disminuir y reducir las habilidades, potestades o bienestar de quien lo sufre; de ah\u00ed que la v\u00edctima no solo no se encuentre c\u00f3moda en el espacio de trabajo, sino que entorpece la estabilidad y el ambiente laboral donde esta se desenvuelve. El acoso puede manifestarse a trav\u00e9s de burlas, del uso de un lenguaje menosprecie las capacidades de las personas, del hostigamiento, del incremento o la disminuci\u00f3n de las actividades laborales, de los ataques f\u00edsicos o verbales, de expresiones calumniosas o prejuicios. La v\u00edctima suele desarrollar estr\u00e9s, ataques de p\u00e1nico, ansiedad, depresi\u00f3n o afectaciones serias que pueden derivar en la muerte por enfermedades o agresiones, o incluso el suicidio. Para el Consejo de Estado, el acoso laboral no es un evento f\u00e1cil de distinguir con eventos individuales que se amparan en la buena fe o en la b\u00fasqueda de mejorar la calidad y operatividad del servicio.
