Ella denunci\u00f3 ante la instituci\u00f3n al rector del colegio por maltrato infantil y acoso laboral. Luego de las denuncias, la profesora fue trasladada a otro colegio. hide_on_mobile=\u00bbsmall-visibility,medium-visibility,large-visibility\u00bb sticky_display=\u00bbnormal,sticky\u00bb]\n<p><b>Hechos del caso:<\/b><\/p>\n<p>Natalia Arbel\u00e1ez Ospina, profesora de ingl\u00e9s en la Instituci\u00f3n Educativa Jos\u00e9 Acevedo y G\u00f3mez (en adelante IEJA), present\u00f3 acci\u00f3n de tutela contra esta instituci\u00f3n, la Alcald\u00eda de Medell\u00edn y la Secretar\u00eda de Educaci\u00f3n de Medell\u00edn. Solicitaba la protecci\u00f3n de sus derechos fundamentales de petici\u00f3n, al trabajo y al debido proceso, los cuales consider\u00f3 vulnerados por la decisi\u00f3n de las entidades mencionadas de trasladarla a otro colegio luego de que denunciara al rector de IEJA por maltrato infantil y acoso laboral.<\/p>\n<p>&nbsp;<\/p>\n<p>En la tutela se\u00f1al\u00f3 que (i) no se dio respuesta de fondo al derecho de petici\u00f3n que hab\u00eda presentado ante la Secretar\u00eda de Educaci\u00f3n de Medell\u00edn en el que ped\u00eda informaci\u00f3n sobre el tr\u00e1mite correspondiente a las quejas por acoso laboral; (ii) el rector de la IEJA la hab\u00eda acosado laboralmente \u2014por ejemplo, quit\u00e1ndole la carga acad\u00e9mica\u2014 y (iii) no debi\u00f3 ser trasladada porque en la instituci\u00f3n hab\u00eda otros dos profesores de ingl\u00e9s con menos antig\u00fcedad y, al haber instaurado una queja por acoso laboral, debi\u00f3 ser tenida en cuenta en \u00faltimo lugar, pues su deseo era continuar vinculada a la IEJA. Conforme con lo anterior, solicit\u00f3 al Juez Constitucional que se ordenara a las entidades responder su petici\u00f3n, restablecer su carga acad\u00e9mica y adoptar las medidas consideraras pertinentes.<\/p>\n<p>&nbsp;<\/p>\n<p>El juez de primera instancia no concedi\u00f3 la tutela porque i) la Secretar\u00eda de Educaci\u00f3n de Medell\u00edn ya hab\u00eda respondido la petici\u00f3n y ii) no exist\u00eda vulneraci\u00f3n de derechos fundamentales derivados de la orden de traslado de instituci\u00f3n educativa.
