Godoy consider\u00f3 que este despido no tuvo una justa causo y vulner\u00f3 sus derechos a la libertad de expresi\u00f3n, de conciencia, al trabajo, y a la no discriminaci\u00f3n, por lo que present\u00f3 acci\u00f3n de tutela. hide_on_mobile=\u00bbsmall-visibility,medium-visibility,large-visibility\u00bb sticky_display=\u00bbnormal,sticky\u00bb]\n<p><b>Hechos del caso:<\/b><\/p>\n<p>M\u00f3nica Godoy fue profesora de tiempo completo y coordinadora del diplomado en Equidad de G\u00e9nero de la Universidad de Ibagu\u00e9. En marzo de 2017 tuvo conocimiento de varios casos de acoso laboral y sexual; las v\u00edctimas eran mujeres del cuerpo de vigilancia de la universidad y los presuntos agresores eran compa\u00f1eros de trabajo y un supervisor. Inform\u00f3 de estos hechos, y tambi\u00e9n de un presunto abuso sexual denunciado por una estudiante, a las directivas de la instituci\u00f3n. Godoy sirvi\u00f3 como mediadora entre la universidad y las v\u00edctimas y formul\u00f3 recomendaciones a la instituci\u00f3n educativa relativas al manejo del debido proceso, ya que los presuntos agresores hab\u00edan sido despedidos sin que las v\u00edctimas tuvieran la oportunidad de ser escuchadas. Tambi\u00e9n recomend\u00f3 dise\u00f1ar un protocolo de atenci\u00f3n para el manejo de casos de acoso laboral y sexual.<\/p>\n<p>Como respuesta, la Universidad de Ibagu\u00e9 despidi\u00f3 a M\u00f3nica Godoy antes de que se terminara su contrato laboral. Por considerar que el despido no tuvo una justa causa, Godoy present\u00f3 una acci\u00f3n de tutela alegando que sus derechos fundamentales a la libertad de conciencia, a la libertad de expresi\u00f3n, al libre desarrollo de la personalidad, a no ser discriminada por su opini\u00f3n y al trabajo hab\u00edan sido vulnerados. Las Instituciones de Educaci\u00f3n Superior (IES), al terminar de forma unilateral un contrato de trabajo sin justa causa (art\u00edculo 64 del C\u00f3digo Sustantivo del Trabajo), deben ejercer esta autonom\u00eda de manera razonable y proporcional. Ello quiere decir que la autonom\u00eda universitaria no puede ser utilizada como excusa para despedir a profesores ni profesoras con base en motivos discriminatorios.
